Terms of conditions of the OBA Plus Mobile App service
"OBA Market" -- OBA Market MMC (TIN: 2903885001), located at the legal address: AZ 5001, Sumgait city, 9th microdistrict, 25C, and the factual address: Baku city, Yasamal district, Huseyn Javid avenue 202 D block, registered under the legislation of the Republic of Azerbaijan as a legal entity.
"Service" -- electronic services provided through the Application with the purpose of informing customers about Owner's store network, providing navigation and location features, delivering information on products and campaigns, forming customer loyalty, providing an electronic review system, and other support functions indicated in the Application.
"User" -- any natural person who downloads the Application to their mobile device and uses the Application.
"Account" -- the registration belonging to a User within the Application and considered active.
"Registration" -- the procedure of creating an Account through the Application based on the User's phone number.
"One-time code (OTP)" -- the one-time code sent to the mobile number entered by the User during Registration through SMS or push notification for account verification purposes.
"Identification code (UID)" -- the unique code assigned individually to the User by the Application during Registration.
"Registered User" -- a User who successfully registers in the Application, verifies their mobile number and has an active Account.
"Goods" -- food and non-food products available for purchase in retail and provided within the network of stores belonging to the Owner.
"Loyalty program" -- a system implemented by the Owner within the Application aimed at forming customer loyalty, including but not limited to cashback/bonus mechanisms, campaign participation, and other advantages specified in the Application.
"Cashback (Bonus)" -- the non-cash virtual value calculated as a percentage equivalent from the User's purchases or activities within the Application and accumulated on the User's balance; cashback cannot be exchanged for cash, withdrawn, or transferred outside the Application unless otherwise provided by these Terms.
"Balance" -- the virtual balance of cashback/bonus accumulated by the User within the Application.
"Store" -- retail points belonging to or operated under the brand of the Owner where Goods are sold.
"Privacy Policy" -- the document regulating the collection, processing, storage, protection and deletion of Users' personal data within the Application, published as an integral part of these Terms.
"Support service" -- the information service presented to Users within the Application enabling Users to receive answers to their questions related to the Application.
"Rating and review system" -- an evaluation mechanism that allows Registered Users to evaluate Goods and share opinions about Goods through the Application.
2.1. By downloading the Application to a mobile device and using the Service, the User confirms that they have read these Terms, fully understood them, and accept them without any reservations.
2.2. The Application operates within the scope defined by these Terms and allows the User to benefit from the electronic information and loyalty service features provided by OBA Market.
2.3. The Personal Data of the User processed during usage of the Application is regulated by the Privacy Policy. The Privacy Policy constitutes an integral part of these Terms. By using the Application, the User accepts the rules for the processing of their Personal Data.
2.4. The Application is provided to the User free of charge. Internet and mobile communication expenses arising from the use of the Application are borne by the User.
2.5. OBA Market reserves the right to change these Terms unilaterally at any time. Changes shall be deemed valid from the moment of publication in the Application.
2.6. The User undertakes to use the Application in accordance with these Terms and the current legislation. Usage for unlawful purposes is strictly prohibited.
3.1. Only Registered Users may participate in the review and rating system within the Application.
3.2. The User may evaluate and write reviews about Goods they have purchased or used and may select whether their name will be displayed publicly or hidden (anonymous).
3.3. Reviews submitted by the User may be shared publicly within the Application and may be used for marketing, promotion, and analytical purposes by OBA Market.
3.4. When writing a review, the User must comply with ethical norms, business ethics, and the legislation of the Republic of Azerbaijan. Reviews must not include:
- insulting, defamatory, or degrading expressions;
- extremist, hateful, discriminatory content;
- threats, harassment, or inappropriate language;
- political or religious propaganda;
- commercial advertising or promotion of third parties;
- personal data of third parties without consent;
- false or misleading information aimed at damaging reputation or trust.
3.5. Reviews must relate directly to Goods or the service experience at the Store.
3.6. OBA Market reserves the right to reject or remove a review if it violates the rules, is not related to Goods or the Application, is aimed at manipulation of ratings, contains unlawful content, or is part of fraudulent or artificial activity.
3.7. OBA Market has the right to moderate reviews without notifying the User and without the obligation to provide justification.
3.8. Reviews submitted by the User form part of the public content of the Application and may be used by OBA Market, without time and geographical limitation, for informational, analytical, and promotional purposes, including social networks and marketing platforms, without requiring additional consent from the User.
4.1. To access certain features and loyalty mechanisms, the User must register within the Application.
4.2. For Registration, the User enters their mobile phone number and confirms it via the one-time code (OTP) received through SMS or push notification.
4.3. During the Registration process, the system assigns a unique Identification Code (UID) to the User.
4.4. The User undertakes to ensure the confidentiality of the OTP and not disclose it to third parties. All actions performed with the OTP are considered to be performed by the User.
4.5. After successful verification, the User acquires "Registered User" status and may use features that require an Account.
4.6. OBA Market does not bear responsibility for cases where the User loses control over their mobile number or grants access to third parties, resulting in unauthorized use of the Account.
5.1. The User confirms that he/she has the capacity to act and that he/she has reached the age necessary for the execution of the transactions provided for by the legislation of the Republic of Azerbaijan under these conditions.
5.2. OBA Market reserves the right to refuse the orders placed by the User in the Service, if the User discovers that he has violated the terms of use. In this case, OBA Market freely determines the methods and grounds for the User's actions to be considered as dishonest and/or in violation of these Rules and has the right not to disclose the mentioned information to third parties.
5.3. OBA Market is not responsible for:
- Temporary problems and interruptions in the activity of the Service and data losses caused by them, as well as the protection and storage of data, the accuracy of its transmission and delivery (except for the cases provided for by the legislation of the Republic of Azerbaijan regarding personal data).
- For the reliability, quality and speed of the Service and for the protection and storage of the data created, used and received by the User (except for the cases provided for by the legislation of the Republic of Azerbaijan regarding personal data).
6.1. Cards that are not used within 6 months are considered passive by OBA Market and the account is deactivated by deleting the bonus (cashback) on their balance.
6.2. The User has the right to delete his/her account at any time on his/her own initiative. To do this, you need to use the "Delete Account" function provided in the Application. The rules regarding the retention and deletion of Personal Data after the deletion of the Account shall apply in accordance with the provisions of the Privacy Policy.
7.1. General information about the game
"Fast Baskets" is a fun loyalty game available on the OBA Plus app. The game is only available to users who have registered and logged in to the App.
7.2. Mechanics and rules of the game
7.2.1. In the process of the game, the User controls the moving basket on the screen and collects points by catching the products that fall from above.
7.2.2. Catching the right products leads to an increase in points, it is necessary to refrain from catching the specified elements (for example, bombs).
7.2.3. Duration and technical parameters of each game session (speed, stages, etc.) are defined by OBA Market and can be displayed separately within the Application.
7.2.4. The maximum number of games per day or other limits (if applicable) may be announced separately in the Application and/or the terms of the campaign.
7.3. Calculation and accounting of points
7.3.1. The points accumulated during the game are recorded in the User's account and stored as technical indicators.
7.3.2. Daily and monthly leaderboards can be formed on the basis of the accumulated points.
7.3.3. Accordingly, in accordance with the established rules, points can be converted into bonus. The terms and conditions for converting to the bonus are determined by OBA Market and are specified separately in the Application and/or the terms and conditions of the campaign.
7.3.4. Conversion of points into bonuses can be carried out automatically or in the manner announced within the campaign.
7.4. Leaderboards
7.4.1. Daily leaderboards are formed on the basis of the points accumulated for the relevant day and may be reset at the specified time at the discretion of OBA Market.
7.4.2. Monthly leaderboards are formed on the basis of the points accumulated for the corresponding month and can be reset at the beginning of each new month.
7.4.3. Only registered users appear in the leaderboards.
7.4.4. The User's name (or pseudonym) and the points collected may be clearly reflected in the leaderboards for other users.
7.5. Reward
7.5.1. OBA Market may reward the Users who achieve the highest results in the leaderboards in accordance with the rules established by the Market.
7.5.2. Prizes are presented in the form of a non-cash bonus, which is added to the bonus balance in the OBA Plus account and can be used for the purchase of goods.
7.5.3. Bonuses cannot be legally transferred to a third party, even if they are cashed, transferred to a bank account or given to third parties; bonuses can only be used by the account holder registered in the Application.
7.5.4. The terms of calculation and calculation of prizes, including special campaign prizes (if applicable), can be indicated in the separately announced game/campaign rules.
7.6. Prohibited Actions
The following actions by the user are prohibited:
- To participate in the game using bots, macros or automated software tools;
- External interference with the game mechanics or technical infrastructure;
- Use modified, broken, or unauthorized modified versions of the Application;
- Manipulative participation of a natural person in the game through several accounts;
- Falsification of points and results, abuse of technical gaps;
- Any action that violates the rights of other users in connection with the Game.
7.7. Sanctions for violations of the rules
7.7.1. In case of detection of prohibited actions, OBA Market has the right to take the following measures:
- To remove the user's game points;
- Remove the user from the daily and monthly leaderboards;
- Cancellation of bonuses and other prizes won;
- Temporarily or completely restrict the User's account and/or block the account.
7.7.2. OBA Market independently determines the grounds for making these decisions and has the right not to disclose the reasons for the imposition of sanctions to third parties.
7.8. Suspension or Modification of the Game
7.8.1. OBA Market reserves the right to terminate the game "Fast Baskets" at any time, to change the rules, duration, system of calculation of points and reward mechanism.
7.8.2. OBA Market undertakes to inform the Users about significant changes made in the Game through notifications and/or other communication channels in the Application.
7.8.3. The suspension of the game or the change of the rules does not result in the cancellation of previously won bonuses, except in exceptional cases where separate conditions may be announced.
8.1. General Provisions
8.1.1. Users can transfer a part of their bonus balances to other OBA Plus users using the functionality provided in the Application.
8.1.2. Bonus transfer is possible only between Users who are registered in the Service and have an active account.
8.1.3. The bonus funds transferred and accepted are not cash, but only store credit (bonus balance), which can be used for the purchase of goods in the OBA Market network.
8.2. Terms and Restrictions of Transfer
8.2.1. The bonus can only be transferred from the bonus balance of the OBA Plus account; The User's cash, bank card funds, or other means of payment are not transferred through this mechanism.
8.2.2. Bonus transfer can be made only between Users whose mobile number has been verified linked to the OBA Plus account.
8.2.3. As a result of the bonus transfer, the bonus balance of the sender is reduced by the corresponding amount, and the bonus balance of the receiving User increases by the same amount.
8.2.4. The transferred bonus cannot be cashed out, transferred to a bank account or used as a means of payment to any third party.
8.2.5. The minimum and maximum amount limit for bonus transfers, as well as the total amount of transfers per day/month are determined by OBA Market and may be specified separately in the Application.
8.3. Access to contact and contact information
8.3.1. In order to facilitate the selection process, the recipient may refer locally to the contact list (phone book) on the User's device.
8.3.2. Access to contacts is carried out only if the User activates the "Transfer" function in the Application, gives the appropriate permission and goes to the recipient selection screen.
8.3.3. When accessing the contact list, the full list of contacts is not transmitted to the servers of OBA Market, is not shared with third parties and is not used for marketing purposes.
8.3.4. The User can also make a bonus transfer by manually entering the recipient's phone number without entering the contacts, if desired.
8.3.5. The User may restrict or revoke access to contacts at any time by using the settings of the device and the Application.
8.4. Security and Monitoring
8.4.1. All bonus transfer transactions are recorded in the technical systems of the Service.
8.4.2. OBA Market reserves the right to temporarily block, delay or cancel a specific transfer transaction in case of detection of signs of fraud, abuse or suspicious transaction, as well as to impose restrictions on the User's account.
8.4.3. OBA Market may set maximum daily, weekly or monthly transfer limits for certain periods for security reasons.
8.5. Cancellation of transfer and disputes
8.5.1. A bonus transfer made voluntarily by the User is usually non-refundable and non-cancelled.
8.5.2. OBA Market may make a decision to cancel the transferred bonus amount and return it to its previous state only in specific cases: if the transfer of the wrong amount is discovered as a result of a technical failure or system error; where the fact of fraud is established; on the basis of the legal requirement of the relevant state authorities.
8.5.3. Complaints regarding the transfer of bonuses can be sent by the User to OBA Market through the feedback channels provided in the Application or info@oba.az e-mail address.
9.1. Barcode scanner function
9.1.1. The Application may provide the User with the opportunity to get information about the product and check its price by scanning the barcode (barcode and/or QR code) of the product in the store or in other environment.
9.1.2. Barcode scanner function is activated only when voluntarily activated by the User and appropriate permissions are granted.
9.1.3. The data obtained through the barcode scanner is compared with the product data available in the database of the Application and OBA Market, and the result is displayed to the User on the screen.
9.2. Camera use (for barcode)
9.2.1. In order for the Barcode scanner function to work, the Application needs access to the device's camera; This output is provided for the purpose of reading the image in real time only.
9.2.2. Images taken during barcode scanning are not stored by the Application or OBA Market as photo or video files, only barcode information (number and/or sequence of symbols) is read and processed.
9.2.3. The User may restrict or revoke access to the camera at any time by using the device settings or the settings within the Application; In this case, the barcode scanner function cannot be used.
9.3. Accuracy of Data and Limitation of Liability
9.3.1. Product prices and other information displayed by the barcode scanner are for informational purposes and may differ between the information provided in the Application and the actual prices in the store.
9.3.2. The final price, which is legally binding on the purchase and sale of goods, is the price indicated only in the receipt formed at the cash register.
9.3.3. OBA Market is not responsible for the differences between the prices shown in the App and the prices actually applied in the store, as well as for losses caused by technical malfunction, delay or non-updating of information.
10.1. Purposes of using the camera
10.1.1. The Application may require access to the device's camera in the following cases:
- To take a profile picture (avatar) of the User and upload it to the Application;
- To scan receipts for cashback or other loyalty purposes (if such functionality exists);
- To scan product barcodes and check prices (in accordance with Section 9 of these Terms).
10.1.2. Camera permission is activated only when the User activates the relevant function in the Application and gives the camera permission on the device.
10.2. Storage of photos and images
10.2.1. In case of taking or selecting a profile picture by the User, the image may be stored in the Application in connection with the User's account, and in this case, the period of storage of the image and the rules of processing are carried out in accordance with the provisions specified in the Privacy Policy.
10.2.2. If the function of scanning purchase receipts is available, the retention period, purposes and deletion rules of receipt images may be specified separately in the Privacy Policy and/or the relevant campaign rules.
10.2.3. During barcode scanning, the camera is used only to read the image in real time; the image file is not stored by the Application or the OBA Market; Only the barcode data will be processed.
10.3. User control and permission management
10.3.1. The User may restrict or revoke access to the camera and photo library for the Application through the device's operating system at any time.
10.3.2. The User may change or delete the profile picture using the relevant parameters in the Application; In this case, the relevant image file will be processed and deleted in accordance with the Privacy Policy.
10.3.3. Cancellation of access to the camera and photo library may result in the limitation or impossibility of certain functions of the Application.
11.1. Use of location data
11.1.1. The Application may refer to information about the User's geographical location in order to show the nearest OBA Market stores, visualize the location of the stores on the map and suggest directions along the route.
11.1.2. Access to location data is provided only if the User has given the appropriate permission on his device and activates the location-based function in the Application.
11.1.3. Location data, as a rule, is processed in real time and is used for technical purposes, such as calculating the distance of the store, determining the route.
11.2. Location regime and storage rules
11.2.1. The Application requires access to location data only in the "When In Use" mode; It is not intended to retrieve location data even if the application does not work in the background.
11.2.2. Location history is not stored in the system on a long-term basis; Location data is primarily used in real-time within the current session.
11.2.3. Processing and possible storage of location data is carried out in accordance with the provisions specified in the Privacy Policy.
11.3. Mapping Services and Third-Party Platforms
11.3.1. The Application may use map services (e.g., Google Maps or other similar services) to display stores on a map and determine routes.
11.3.2. During the use of the Map Services, certain technical information about the User's location and device may be transferred to the relevant service provider; In this case, the privacy policy and terms of use of that provider may also apply.
11.3.3. The User may restrict or revoke the location permission at any time due to device settings; In this case, the location-based functions of the Application may be restricted or unavailable for use.

Hesab -- Tətbiq daxilində İstifadəçiyə məxsus qeydiyyat və aktiv sayılan hesab.
Qeydiyyat -- İstifadəçinin telefon nömrəsini əsas tutaraq Tətbiq vasitəsilə hesab yaratma proseduru.
Birdəfəlik kod (OTP) -- hesab doğrulanması məqsədilə qeydiyyat zamanı İstifadəçinin daxil etdiyi mobil nömrəyə SMS və ya push bildirişi vasitəsilə göndərilən birdəfəlik kod.
Identifikasiya kodu (UID) -- qeydiyyat zamanı Tətbiq tərəfindən İstifadəçiyə fərdi olaraq təyin edilən unikal kod.
Qeydiyyatdan keçmiş İstifadəçi -- Tətbiqdə uğurla qeydiyyatdan keçən, mobil nömrəsini doğrulayan və aktiv hesabı olan İstifadəçi.
Mallar -- Mülkiyyətçiyə məxsus mağaza şəbəkəsində satılmaq üçün mövcud olan gida və qida olmayan məhsullar.
Loyallıq proqramı -- Mülkiyyətçi tərəfindən Tətbiq daxilində müştəri loyallığını formalaşdırmaq üçün həyata keçirilən sistem, o cümlədən keşbek/bonus mexanizmləri, kampaniyalara iştirak və Tətbiqdə göstərilən digər üstünlüklər.

Balans -- İstifadəçi tərəfindən Tətbiq daxilində yığılmış keşbek/bonus virtual balansı.
Mağaza -- Mülkiyyətçiyə məxsus və ya Mülkiyyətçinin brendindən istifadə etməklə idarə olunan və malların satıldığı pərakəndə nöqtələri.
Məxfilik Siyasəti -- Tətbiq daxilində İstifadəçilərin fərdi məlumatlarının toplanılması, işlənilməsi, saxlanılması, mühafizəsi və silinməsini tənzimləyən sənəd və bu Şərtlərin ayrılmaz hissəsi olun.
Dəstək xidməti -- Tətbiq daxilində İstifadəçilərə Tətbiq ilə bağlı suallarının cavablarını almaq imkanı verən məlumat xidməti.
Reytinq və rəy sistemi -- Qeydiyyatdan keçmiş İstifadəçilərə Malları qiymətləndirmə və Mallar haqqında fikirləri Tətbiq vasitəsilə bölüşmə imkanı verən qiymətləndirmə mexanizmi.
2.1. Tətbiqi mobil cihazına yükləyən və Servisindən istifadə edən İstifadəçi bu Şərtləri oxuduğunu, tam başa düşdüyünü və heç bir qeyd olmadan qəbul etdiyini təsdiq edir.
2.2. Tətbiq bu Şərtlər tərəfindən müəyyən edilmiş əhatə daxilində işləyir və İstifadəçiyə OBA Market tərəfindən təqdim olunan elektron məlumat və loyallıq xidməti funksiyalarından istifadə etmə imkanı verir.
2.3. İstifadəçinin Tətbiq istifadəsi zamanı işlənən Şəxsi Məlumatları Məxfilik Siyasəti tərəfindən tənzimləməsi. Məxfilik Siyasəti bu Şərtlərin ayrılmaz hissəsini təşkil edir. Tətbiqdən istifadə etməklə, İstifadəçi öz Şəxsi Məlumatlarının işlənməsi qaydalarını qəbul edir.
2.4. Tətbiq İstifadəçiyə pulsuz təqdim olunur. Tətbiqdən istifadə etməkdən irəli gələn İnternet və mobil rabitə xərcləri İstifadəçi tərəfindən daşınır.
2.5. OBA Market istənilən vaxt bu Şərtləri tərəfli olaraq dəyişdirmə hüququna malikdir. Dəyişikliklər Tətbiqdə dərc olunduğu andan başlamaqla qüvvəyə minir.
2.6. İstifadəçi bu Şərtlərə və cari qanunvericiliyə uyğun olaraq Tətbiqindən istifadə etməyi öhdəsinə götürür. Qanunsuz məqsədlər üçün istifadə sərt qadağandır.
3.1. Yalnız Qeydiyyatdan keçmiş İstifadəçilər Tətbiq daxilində rəy və reytinq sisteminə iştirak edə bilərlər.
3.2. İstifadəçi satın aldığı və ya istifadə etdiyi Mallar barədə rəy yazıb qiymətləndirə biləcəkdir və adının açıq şəkildə göstərilməsi yoxsa gizli (adsız) saxlanması seçə biləcəkdir.
3.3. İstifadəçi tərəfindən təqdim olunan rəylər Tətbiq daxilində açıq şəkildə bölüşülə biləcəkdir və OBA Market tərəfindən marketinq, təbliğ və analitik məqsədlər üçün istifadə oluna biləcəkdir.
3.4. Rəy yazarkən İstifadəçi etika normalarına, biznes etikasına və Azərbaycan Respublikasının qanunvericiliyinə uyğun davranmalıdır. Rəylər aşağıdakıları daxil etməməlidir:
- təhqirEdici, böhtanqor və ya aşağılayıcı ifadələr;
- ekstremist, nifrətlə dolu, diskriminasiya dolu məzmun;
- tehdidlər, təqib və ya uyğun olmayan dil;
- siyasi və ya dini təbliğat;
- üçüncü tərəfin ticarət reklam və ya təbliği;
- üçüncü tərəfin şəxsi məlumatları razılıq olmadan;
- reputasiya və ya etimada zərər vərmək məqsədilə saxta və ya yanlamaş məlumat.
3.5. Rəylər birbaşa Mallara və ya Mağazadakı xidmət təcrübəsinə aidiyyətli olmalıdır.
3.6. OBA Market rəyi reddətmə və ya silmə hüququna malikdir, əgər belə rəy qaydaları pozarsa, Mallara və ya Tətbiqə aid olmayarsa, reytinqlərin idarə edilməsini məqsəd oluyursa, qanunsuz məzmun yaxud fırıldaqçılıq və ya süni fəaliyyət hissəsi olarsa.
3.7. OBA Market rəyləri İstifadəçini xəbərdar etmədən və əsaslandırma vermə öhdəliyində olmadığı halda moderasyon edə biləcəkdir.
3.8. İstifadəçi tərəfindən təqdim olunan rəylər Tətbiqin ictimai məzmununun hissəsini təşkil edir və OBA Market tərəfindən vaxtsız və coğrafi məhdudiyyət olmadan informasiya, analitika və təbliğat məqsədləri üçün, o cümlədən sosial şəbəkələr və marketinq platformalarında İstifadəçidən əlavə razılıq istəmədən istifadə oluna biləcəkdir.
4.1. Bəzi funksiyalar və loyallıq mexanizmlərə çıxış üçün İstifadəçi Tətbiq daxilində qeydiyyatdan keçməlidir.
4.2. Qeydiyyat üçün İstifadəçi mobil telefon nömrəsini daxil edir və SMS və ya push bildirişi ilə aldığı birdəfəlik kod (OTP) vasitəsilə bunu təsdiq edir.
4.3. Qeydiyyat prosesi zamanı sistem İstifadəçiyə unikal Identifikasiya Kodu (UID) təyin edir.
4.4. İstifadəçi OTP-nin sirliliyi qorumalı və üçüncü tərəflərə açıqlamalı deyil. OTP ilə aparılan bütün hərəkətlər İstifadəçi tərəfindən aparıldığı hesab edilir.
4.5. Uğurlu doğrulanmadan sonra İstifadəçi "Qeydiyyatdan keçmiş İstifadəçi" statusu alır və hesab tələb edən funksiyaları istifadə edə biləcəkdir.
4.6. OBA Market İstifadəçinin mobil nömrə üzərində nəzarət itirir və ya üçüncü tərəflərə giriş verdiyi hallarda qeydiyyatsız hesab istifadəsinə sorumlu deyil.
5.1. İstifadəçi hərəkət qabiliyyətinə və Azərbaycan Respublikasının qanunvericiliyi ilə nəzərdə tutulan əməliyyatlar üçün zəruri yaşa çatdığını təsdiq edir.
5.2. OBA Market İstifadəçi istifadə şərtlərini pozarsa, Servisdə İstifadəçi tərəfindən yerləşdiriləm sifarişləri rədd etmə hüququna malikdir. Bu halda OBA Market müstəqil olaraq İstifadəçinin hərəkətlərini enamdışı və/və ya bu Qaydalara zidd sayılması şərtlərini və əsaslarını müəyyən edir və bu məlumatı üçüncü tərəflərə açıqlamamaq hüququna malikdir.
5.3. OBA Market aşağıdakılara sorumlu deyil:
- Servisində müvəqqəti problemlər və kəsmələr və onların səbəb olduğu məlumat itirmələri, eləcə də məlumatların mühafizəsi və saxlanılması, onun ötürülməsinin dəqiqliyi və çatdırılması (Azərbaycan Respublikasının şəxsi məlumatlar barədə qanunvericiliyi ilə nəzərdə tutulan halları istisna olmaqla).
- Servisin etibarlılığı, keyfiyyəti və sürəti və İstifadəçi tərəfindən yaradılan, istifadə olunan və alınan məlumatların mühafizəsi və saxlanılması (Azərbaycan Respublikasının şəxsi məlumatlar barədə qanunvericiliyi ilə nəzərdə tutulan halları istisna olmaqla).
6.1. 6 ay ərzində istifadə olunmayan kartlar OBA Market tərəfindən pasiv sayılır və hesab onların balansından bonus (keşbek) silməklə deaktivləşdirilir.
6.2. İstifadəçi istənilən vaxt öz inisiyativi ilə hesabını silmə hüququna malikdir. Bunun üçün Tətbiqdə təqdim olunan "Hesabı Sil" funksiyasından istifadə etməli. Hesabın silinməsindən sonra Şəxsi Məlumatların saxlanılması və silinməsi qaydaları Məxfilik Siyasətinin müddəalarına uyğun tətbiq olunacaq.
7.1. Oyun haqqında ümumi məlumat
"Sürətli Səbətlər" OBA Plus tətbiqində mövcud olan əyləncəli loyallıq oyunudur. Oyun yalnız Tətbiqə qeydiyyatdan keçən və daxil olan istifadəçilər üçün əlçatandır.
7.2. Oyunun mexanizmi və qaydaları
7.2.1. Oyun prosesində İstifadəçi ekranda hərəkət edən səbəti idarə edir və yuxarıdan düşən məhsulları tutaraq xal toplayır.
7.2.2. Düzgün məhsulları tutmaq xalları artırır, müəyyən elementləri (məsələn, bombalar) tutmaqdan imtina etmə zəruridir.
7.2.3. Hər bir oyun sessiyasının müddəti və texniki parametrləri (sürət, mərhələlər və s.) OBA Market tərəfindən müəyyən edilir və Tətbiq daxilində ayrıca göstərilə biləcəkdir.
7.2.4. Günə bir oyunun maksimum sayı və ya digər məhdudiyyətlər (əgər varsa) Tətbiqdə və ya kampaniya şərtlərində ayrıca elan edilə biləcəkdir.
7.3. Xalların hesablanması və uçotu
7.3.1. Oyun zamanı yığılmış xallar İstifadəçinin hesabında qeyd olunur və texniki göstəricilər kimi saxlanılır.
7.3.2. Gündəlik və aylıq reytinq cədvəlləri yığılmış xallara əsasən formalaşdırıla biləcəkdir.
7.3.3. Müvafiq olaraq, qurulan qaydalar altında xallar bonusa çevrilə biləcəkdir. Bona çevrilmə şərtləri OBA Market tərəfindən müəyyən edilir və Tətbiq daxilində və ya kampaniya şərtlərində ayrıca göstərilir.
7.3.4. Xalların bonusa çevrilməsi avtomatik olaraq və ya kampaniya daxilində elan edilən qaydada həyata keçirilə biləcəkdir.
7.4. Reytinq cədvəlləri
7.4.1. Gündəlik reytinq cədvəlləri müvafiq günə yığılmış xallara əsasən formalaşdırılır və OBA Market mülahizəsi altında müəyyən edilmiş vaxtda sıfırlanıla biləcəkdir.
7.4.2. Aylıq reytinq cədvəlləri müvafiq aya yığılmış xallara əsasən formalaşdırılır və hər yeni ayın əvvəlində sıfırlanıla biləcəkdir.
7.4.3. Reytinq cədvəllərinə yalnız qeydiyyatdan keçmiş istifadəçilər daxil olurlar.
7.4.4. İstifadəçinin adı (və ya psoevdonimi) və toplanan xallar digər istifadəçilər üçün reytinq cədvəllərində aydın şəkildə göstərilə biləcəkdir.
7.5. Mükafat
7.5.1. OBA Market reytinq cədvəllərinə ən yüksək nəticələr əldə edən İstifadəçiləri Market tərəfindən qurulan qaydalar əsasında mükafatlandıra biləcəkdir.
7.5.2. Mükafatlar qeyri-nağd bonus formasında təqdim olunur, OBA Plus hesabında bonus balansına əlavə olunur və mallara satınalma üçün istifadə oluna biləcəkdir.
7.5.3. Bonuslar nağdlaşdırıla, bankada hesaba ötürülə, yaxud üçüncü şəxslərə verilə bilsə də, qanuni olaraq üçüncü tərəfə ötürülə bilməz; bonuslar yalnız Tətbiqdə qeydiyyatdan keçən hesab sahibi tərəfindən istifadə oluna biləcəkdir.
7.5.4. Mükafatların hesablanması və hesablanması şərtləri, o cümlədən xüsusi kampaniya mükafatları (əgər varsa), ayrıca elan olunan oyun/kampaniya qaydalarında göstərilə biləcəkdir.
7.6. Qadağan edilmiş Fəaliyyətlər
İstifadəçi tərəfindən aşağıdakı hərəkətlər qadağandır:
- Botlar, makrolar və ya avtomatik proqram vasitələrindən istifadə edərək oyunda iştirak etmə;
- Oyun mexanikinə və ya texniki infrastrukturuna xarici müdaxilə;
- Tətbiqin dəyişdirilmiş, qırılmış və ya qanunsuz dəyişdirilmiş versiyalarından istifadə etmə;
- Fiziki şəxsin bir neçə hesab vasitəsilə manipulyativ oyun iştirakı;
- Xalların və nəticələrin saxta göstərilməsi, texniki boşluqlardan sui-istifadə;
- Oyunla bağlı digər istifadəçilərin hüquqlarını pozan hər hansı bir hərəkət.
7.7. Qaydaların pozulmasına görə sanksiyalar
7.7.1. Qadağan edilmiş hərəkətlərin aşkar olunması halında, OBA Market aşağıdakı tədbirləri almaq hüququna malikdir:
- İstifadəçinin oyun xallarını silmə;
- İstifadəçini gündəlik və aylıq reytinq cədvəllərindən çıxarma;
- Qazanılan bonusların və digər mükafatların ləğvi;
- İstifadəçinin hesabına müvəqqət və ya tam məhdudiyyət və ya hesabı bloklamaq.
7.7.2. OBA Market bu qərarları almaq əsasını müstəqil olaraq müəyyən edir və sanksiyaların tətbiq edilməsinin səbəblərini üçüncü tərəflərə açıqlamamaq hüququna malikdir.
7.8. Oyunun Dayandırılması və ya Dəyişdirilməsi
7.8.1. OBA Market "Sürətli Səbətlər" oyununu istənilən vaxt dayandırmaq, qaydaları dəyişdirmək, xalların hesablanması müddətini və mükafat mexanizmini dəyişdirmə hüququna malikdir.
7.8.2. OBA Market İstifadəçiləri Oyunda edilən əhəmiyyətli dəyişikliklər barədə bildirişlər və ya Tətbiq daxilində digər rabitə kanalları vasitəsilə xəbərdar etməyi öhdəsinə götürür.
7.8.3. Oyunun dayandırılması və ya qaydaların dəyişdirilməsi əvvəllər qazanılan bonusların ləğvində nəticəsinə gətirmir, müstəsnai hallarda ayrıca şərtlər elan oluna biləcəkdir.
8.1. Ümumi Müddəalar
8.1.1. İstifadəçilər Tətbiqdə təqdim olunan funksiyalardan istifadə edərək bonus balanslarının bir hissəsini digər OBA Plus istifadəçilərinə ötürə biləcəklərdir.
8.1.2. Bonus ötürülməsi yalnız Servisdə qeydiyyatdan keçən və aktiv hesabı olan İstifadəçilər arasında mümkündür.
8.1.3. Ötürülən və qəbul edilən bonus vəsaitləri nağd deyil, yalnız mağaza krediti (bonus balansı) olub, OBA Market şəbəkəsində mallara satınalma üçün istifadə oluna biləcəkdir.
8.2. Ötürülmə Şərtləri və Məhdudiyyətləri
8.2.1. Bonus yalnız OBA Plus hesabının bonus balansından ötürülə biləcəkdir; İstifadəçinin nağdı, bank kartı vəsaitləri və ya digər ödəniş vasitələri bu mexanizm vasitəsilə ötürülmür.
8.2.2. Bonus ötürülməsi yalnız mobil nömrəsi doğrulanmış İstifadəçilər arasında mümkündür OBA Plus hesabında bağlı.
8.2.3. Bonus ötürülməsinin nəticəsi olaraq, göndərənin bonus balansı müvafiq məbləğ ilə azalır və qəbul edən İstifadəçinin bonus balansı eyni məbləğ ilə artır.
8.2.4. Ötürülən bonus nağdlaşdırıla bilməz, bankada hesaba ötürülə bilməz və ya üçüncü tərəfə ödəniş vasitəsi kimi istifadə oluna bilməz.
8.2.5. Bonus ötürülməsinin minimum və maksimum məbləğ həddi, habelə günə/ayda ötürülmənin ümumi məbləğ OBA Market tərəfindən müəyyən edilir və Tətbiqdə ayrıca göstərilə biləcəkdir.
8.3. Kontaktlara Giriş və Kontakt Məlumatları
8.3.1. Seçim prosesini asanlaşdırmaq üçün, alıcı İstifadəçinin cihazındakı kontakt siyahısına (telefon dəftəri) yerli olaraq baxa biləcəkdir.
8.3.2. Kontaktlara giriş yalnız İstifadəçi Tətbiqdə "Ötürülmə" funksiyasını aktivləşdirdikdə, müvafiq icazə verdikdə və alıcı seçim ekranına keçdikdə həyata keçirilir.
8.3.3. Kontakt siyahısına girişdə, kontaktların tam siyahısı OBA Market serverlərinə ötürülmür, üçüncü tərəflərə paylaşılmır və marketinq üçün istifadə olunmur.
8.3.4. İstifadəçi istəyi halda kontaktlara girmədən alıcının telefon nömrəsini əl ilə daxil edərək bonus ötürülməsi həyata keçirə biləcəkdir.
8.3.5. İstifadəçi cihaz və Tətbiq parametrlərindən istifadə edərək istənilən vaxt kontaktlara girişi məhdudlaşdıra və ya geri çəkə biləcəkdir.
8.4. Təhlükəsizlik və Monitorinq
8.4.1. Bütün bonus ötürülmə əməliyyatları Servisin texniki sistemlərində qeyd olunur və saxlanılır.
8.4.2. OBA Market fırıldaqçılıq, sui-istifadə və ya şübhəli əməliyyat əlamətləri aşkar edildiyi halda, müəyyən ötürülmə əməliyyatını müvəqqət olaraq bloklamaq, gecikdirmək və ya ləğv etmə hüququna, habelə İstifadəçinin hesabına məhdudiyyət qoya biləcəkdir.
8.4.3. OBA Market təhlükəsizlik səbəblərinə görə müəyyən müddətlər üçün gündəlik, həftəlik və ya aylıq ötürülmə hədləri təyin edə biləcəkdir.
8.5. Ötürülmənin Ləğvi və Mübahisələr
8.5.1. İstifadəçi tərəfindən könüllü olaraq aparılan bonus ötürülməsi adətən geri qaytarıla bilməz və ləğv edilə bilməz.
8.5.2. OBA Market ötürülən bonus məbləğini ləğv etmə və əvvəlki vəziyyətə qaytarma qərarı yalnız müəyyən hallarda verə biləcəkdir: texniki arıza və ya sistem xətası nəticəsində yanlış məbləğin ötürülməsi aşkar olunduğu halda; fırıldaqçılıq faktı müəyyən edildikdə; müvafiq dövlət orqanlarının hüquqi tələbi əsasında.
8.5.3. Bonus ötürülməsi ilə bağlı şikayətlər İstifadəçi tərəfindən Tətbiq daxilində təqdim olunan geri bildirim kanalları vasitəsilə və ya info@oba.az e-poçt ünvanına OBA Market-ə göndərilə biləcəkdir.
9.1. Ştrix-kod skaneri funksiyası
9.1.1. Tətbiq İstifadəçiyə mağaza və ya digər mühitdə məhsulun ştrix-kodasını (ştrix-kod və ya QR-kod) skan etməklə məhsul haqqında məlumat almaq və onun qiymətini yoxlamaq imkanı verə biləcəkdir.
9.1.2. Ştrix-kod skaneri funksiyası yalnız İstifadəçi tərəfindən könüllü aktivləşdirildikdə və müvafiq icazələr verildiyi zaman aktivləşdirilir.
9.1.3. Ştrix-kod skaneri vasitəsilə əldə edilən məlumatlar Tətbiq və OBA Market verilənləri bazasında mövcud olan məhsul məlumatları ilə müqayisə edilir və nəticə İstifadəçiyə ekranda göstərilir.
9.2. Kamera Istifadəsi (ştrix-kod üçün)
9.2.1. Ştrix-kod skaneri funksiyasının işləməsi üçün Tətbiq cihazın kamerasına giriş tələb edir; Bu çıxış yalnız şəkli real vaxtda oxumaq məqsədilə təqdim olunur.
9.2.2. Ştrix-kod skan zamanı çəkilən şəkillər Tətbiq və ya OBA Market tərəfindən foto və ya video faylları kimi saxlanılmır, yalnız ştrix-kod məlumatları (rəqəm və/və ya simvollar ardıcıllığı) oxunur və işlənilir.
9.2.3. İstifadəçi cihaz parametrləri və ya Tətbiq parametrləri vasitəsilə istənilən vaxt kamerada girişi məhdudlaşdıra və ya geri çəkə biləcəkdir; bu halda ştrix-kod skaneri funksiyası istifadə edilə bilməyəcəkdir.
9.3. Məlumatların Dəqiqliyi və Məsuliyyət Məhdudiyyətləri
9.3.1. Ştrix-kod skaneri tərəfindən göstərilən məhsul qiymətləri və digər məlumatlar informasion məqsədlər üçün nəzərdə tutulmuş və Tətbiqdə göstərilən məlumatlar və mağazadakı faktiki qiymətlər arasında fərq ola biləcəkdir.
9.3.2. Mal alqı-satqısında qanuni olaraq bağlayıcı final qiymət yalnız kassa nöqtəsində formalaşdırılan qəbzində göstərilən qiymətdir.
9.3.3. OBA Market tətbiqdə göstərilən qiymətlər ilə mağazada tətbiq olunan qiymətlər arasında fərqə, habelə texniki xətalanma, gecikdirmə və ya məlumatın yenilənməməsi səbəbilə səbəb olunan zərərlərə sorumlu deyil.
10.1. Kamera İstifadəsinin Məqsədləri
10.1.1. Tətbiq aşağıdakı hallarda cihazın kamerasına giriş tələb edə biləcəkdir:
- İstifadəçinin profil şəkli (avatar) çəkmək və Tətbiqə yükləmək;
- Keşbek və ya digər loyallıq məqsədləri üçün qəbzləri skan etmək (belə funksiya varsa);
- Məhsul ştrix-kodlarını skan etmək və qiymətləri yoxlamaq (bu Şərtlərin 9-cu Bölməsinə uyğun).
10.1.2. Kamera icazəsi yalnız İstifadəçi Tətbiqdə müvafiq funksiyasını aktivləşdirdikdə və cihazda kamera icazəsi verdikdə aktivləşdirilir.
10.2. Şəkillərin və Şəkillərin Saxlanılması
10.2.1. İstifadəçi tərəfindən profil şəkli çəkildiyi və ya seçildiyi halda, şəkil Tətbiq daxilində İstifadəçinin hesabı ilə əlaqəli olaraq saxlanıla biləcəkdir və bu halda şəklin saxlanılma müddəti və emalı qaydaları Məxfilik Siyasətində göstərilən müddəalarına uyğun həyata keçirilir.
10.2.2. Alış-veriş qəbzinin skan funksiyası mövcud olduğu halda, qəbz şəkillərinin saxlanılma müddəti, məqsədləri və silmə qaydaları Məxfilik Siyasətində və/və ya müvafiq kampaniya qaydalarında ayrıca göstərilə biləcəkdir.
10.2.3. Ştrix-kod skan zamanı kamera yalnız şəkli real vaxtda oxumaq üçün istifadə olunur; şəkil faylı Tətbiq və ya OBA Market tərəfindən saxlanılmır; Yalnız ştrix-kod məlumatları işlənəcəkdir.
10.3. İstifadəçi Nəzarəti və Icazə İdarəsi
10.3.1. İstifadəçi cihazın əməliyyat sistemi vasitəsilə istənilən vaxt Tətbiqə kamera və foto kitabxanasına girişi məhdudlaşdıra və ya geri çəkə biləcəkdir.
10.3.2. İstifadəçi Tətbiq daxilində müvafiq parametrlərdən istifadə edərək profil şəklini dəyişdirə və ya silə biləcəkdir; bu halda müvafiq şəkil faylı Məxfilik Siyasətinə uyğun emal edilir və silinir.
10.3.3. Kameraya və foto kitabxanasına girişin ləğvi Tətbiqin bəzi funksiyalarının məhdudlaşdırılması və ya imkansızlaşması ilə nəticələnə biləcəkdir.
11.1. Lokasiya Məlumatlarının İstifadəsi
11.1.1. Tətbiq İstifadəçinin coğrafi lokasiyası (lokasiya məlumatları) haqqında məlumatdan ən yaxın OBA Market mağazalarını göstərmək, mağazaların lokasiyasını xəritə üzərində vizualize etmək və marşrutda istiqamətlər təklifu vermək məqsədləri ilə istifadə edə biləcəkdir.
11.1.2. Lokasiya məlumatlarına giriş yalnız İstifadəçi cihazında müvafiq icazə verdikdə və Tətbiqdə lokasiya əsaslı funksiyasını aktivləşdirdikdə təqdim olunur.
11.1.3. Lokasiya məlumatları, bir qayda olaraq, real vaxtda işlənilir və mağazanın məsafəsini hesablamaq, marşrutu müəyyən etmək kimi texniki məqsədlər üçün istifadə olunur.
11.2. Lokasiya Rejimi və Saxlanılma Qaydaları
11.2.1. Tətbiq lokasiya məlumatlarına yalnız "İstifadə Zamanı" rejimində giriş tələb edir; Tətbiq arxa planda işləmədikdə belə lokasiya məlumatlarını almaq nəzərdə tutulmur.
11.2.2. Lokasiya tarixi uzunmüddətli olaraq sistemdə saxlanılmır; Lokasiya məlumatları əsasən cari sessiya daxilində real vaxtda istifadə olunur.
11.2.3. Lokasiya məlumatlarının emalı və mümkün saxlanılması Məxfilik Siyasətində göstərilən müddəalarına uyğun həyata keçirilir.
11.3. Xəritə Xidmətləri və Üçüncü Tərəf Platformaları
11.3.1. Tətbiq xəritə xidmətlərindən (məsələn, Google Xəritəsi və ya digər oxşar xidmətlər) mağazaları xəritə üzərində göstərmək və marşrutları müəyyən etmək üçün istifadə edə biləcəkdir.
11.3.2. Xəritə Xidmətlərinin istifadəsi zamanı İstifadəçinin lokasiyası və cihazı haqqında müəyyən texniki məlumatlar müvafiq xidmət təminatçısına ötürülə biləcəkdir; bu halda həmin təminatçının məxfilik siyasəti və istifadə şərtləri də tətbiq oluna biləcəkdir.
11.3.3. İstifadəçi cihaz parametrləri əsasında istənilən vaxt lokasiya icazəsini məhdudlaşdıra və ya geri çəkə biləcəkdir; bu halda Tətbiqin lokasiya əsaslı funksiyaları (ən yaxın mağazanı göstərmə, xəritə üzərində marşrutlaşdırma və s.) məhdud və ya istifadəyə hazır olmaya biləcəkdir.
